What does the FOIA process cost?
For requests from private individuals (non-commercial requests), agencies are allowed to charge only for the costs of finding and copying the requested records. The first two hours of research and the first 100 pages of copying are free, so simple requests are often handled without charge. Additional research time can cost from $10 - $30 per hour. Additional copying fees start at 10 cents a page, but can go much higher depending on the size and condition of the original documents. Agencies will usually notify you of any fees before proceeding.
You can also request that any an all fees be waived by demonstrating that your possession of the records will contribute to the public's understanding of government operations.
How long does this take?
By law, agencies must respond to FOIA requests within 10 working days of receipt. Agencies may extend this time if necessary, but they must send the requestor written notice of the extension.
What if an FOIA request is denied?
Sometimes, the agency simply does not have or cannot locate the requested records. But if the records are found, only the information or parts of information exempted from disclosure can be withheld. If the agency finds and withholds any or all of the information, the agency must notify the requestor of the reason and inform them of the appeals process. Appeals should be sent to the agency in writing within 45 days.
The appeals process may very between agencies. While the Justice Department's FOIA appeals process is typical, each agency's FOIA web site will include complete instructions.
