ACORN Sues US Congress

The Center for Constitutional Rights (CCR) has filed a lawsuit claiming that the United States Congress violated the constitutional rights of the Association of Community Organizations for Reform Now (ACORN) when it voted to ban further federal funding for the community organization and activism group.

The suit charges Congress with violating the Constitution's ban against bills of attainder by declaring ACRON guilty of a crime and assessing a punishment without the benefit of trial.

ACORN has been accused of fraudulently registering non-qualified voters in several states. ACORN-employed community counselors were also videotaped advising people posing as a pimp and a prostitute on how to get a mortgage loan to open a brothel.

The Center for Constitutional Rights further claims that Congress violated ACORN's Fifth Amendment right to due process and its First Amendment right to freedom of association by targeting organizations affiliated with ACORN.

"It is outrageous to see Congress violating the Constitution for purposes of political grandstanding," said CCR legal director Bill Quigley in a press release. "With all the crimes and infractions committed by banks, pharmaceutical companies, and private government contractors, they have been rewarded with bailouts, tax credits, and billions of dollars in new contracts. Congress bowed to FOX News and joined in the scapegoating of an organization that helps average Americans going through hard times to get homes, pay their taxes, and vote. Shame on them."

The suit asks the courts to issue a temporary restraining order preventing Congress from reallocating the funds it has set aside for ACORN. The case is ACORN v. USA and was filed in federal court in the Eastern District of New York.
